Summary of Content

In-depth understanding of contract administration in a modern commercial environment

Syllabus

Introduction to the ICE Conditions 7th Edition: the role of the parties, instructions, certificates, interim and final payments, variations, claims.Further study of JCT 98: insurances, determination, final accounts and the status of the final certificate. Problems associated with the incorporation of standard methods of measurement into standard forms of contract. The Private Finance Initiative/Public-Private Partnerships: procedures and contractual arrangements.Partnering: the partnering charter, the partnering agreement; a critique of the PPC2000 form of contract. The Engineering and Construction Contract.Forms of contract on major new build work overseas. A comparison of legal systems based on Common Law and Roman Law; a critique of the use of standard forms of contract under different legal systems. Contemporary developments in case law and legislation.

Learning Outcomes

On completion of this module students should be able to:-Demonstrate a professional understanding of contract forms for modern complex projects. Ability to give advice on the selection of modern procurement routes and associated contractual relationships.

Teaching / Learning Strategy

Lectures will concentrate on principles and students will be expected to undertake significant private study. Project work will be a mix of role plays and presentations. Some seminar material will delivered via the web.
