Summary of Content

Ophthalmic administration: all legislation relating to Ophthalmic practice; the Opticians Act, NHS and General Ophthalmic Services. General law: Law of Contract, Negligence, Consumer Law etc. Management: An understanding of key management issues relevant to professional practice, risk management and health and safety. Medical ethics and audit: the principles of medical ethics audit principles as they apply in private practice and within the Hospital Eye Service

Syllabus

Ophthalmic Administration The Opticians Act 1958, Health and Social Security Act 1984, Health and Medicines Act 1988, The Opticians Act 1989. The General Optical Council, Committees, Registration, Rules, Disciplinary Procedures. The National Health Service, NHS organisation in Scotland, England and Wales, General Ophthalmic Service, NHS Administration, GOS forms. Health Service Complaints Procedure: local resolution, NHS tribunal. Professional bodies, organisation, functions, guidelines, codes of conduct. General Law Introduction to Scots Law: sources of the Law, in particular legislation and judicial precedent. The Court system in Scotland. Law of contract: Discussion of obligations undertaken by agreement (contract) and those imposed by the law (negligence). Gratuitous promises, Formation of a contract, Consensus in id em, Error Formality - Probative writing, Pactum illicitum - restrictive covenants Remedies for Breach of Contact, Rescission, Damages, Specific Implement Defensive remedies, Termination of a Contract Consumer Law: Sale of goods Act 1979, Implied Terms, Ownership and Risk, Sale by non-owner, Performance of a contract, Remedies for Breach of Contract, Production Liability, Buyer's contractual rights, manufacturer's guarantees, Consumer Protection Act 1987. Health and Safety Legislation Management Key management functions that underpin good practice; identifies the value adding activities in the practice of Optometry and Ophthalmic Dispensing; identifies and defines good professional practice which encompasses the various activities, conducts, procedures and practices for effective management of professional organisations; 'management of resources' including human, financial, technological and intellectual. Personnel management, managing people, communication, leadership, appraisal, recruitment Formulating a business plan, forecasting, organisation and control. Medical Ethics and Audit The foundation of medical ethics applied to clinical practice and development of ethical perspectives. Relevant ethical issues in clinical practice; confidentiality; reconciliation of commercial and ethical issues; Equality Act 2010 and Data Protection Clinical governance in relation to Optometry and Ophthalmic Dispensing Audit of clinical outcomes, both large and small scale Consent for research and Declaration of Helsinki

Learning Outcomes

On successful completion of this module the student should be able to:-1. Demonstrate a knowledge and understanding of management theory in relation to management of an optical practice.2. Demonstrate a knowledge and understanding of the principles of consumer and contract law3. Demonstrate knowledge and understanding of legislation relating to The Opticians Act 19894. Demonstrate an understanding of the functions of the relevant professional bodies5. Demonstrate knowledge of the functions of the General Optical Council, including understanding of fitness to practice6. Demonstrate knowledge of the National Health Service organisation and practice within General Ophthalmic Services7. Demonstrate an understanding of ethical guidelines and standards8. Demonstrate an understanding of clinical governance including audit
